Canadian Tribunal finds a reasonable indication of injury concerning paperboard cups imported from China

On October 16, 2026, the Canadian International Trade Tribunal (CITT) issued its preliminary determination of injury in inquiry PI-2026-004 concerning paperboard cups and containers originating in or exported from China. It found that the evidence provides a reasonable indication that the dumping and subsidizing of the goods under investigation have caused injury to the domestic industry.

An important step for Canadian manufacturers

This decision marks a step in the proceedings that followed the launch of investigations by the Canada Border Services Agency (CBSA) on August 17, 2026. It allows the investigation process to continue. This is a preliminary finding on injury, rather than a final decision on the entire case.

The Tribunal states that its reasons will be issued within 15 days of the decision. That document will provide further details on the basis for its finding.

Which products are covered?

The case covers paperboard cups and containers rolled from coated paperboard, as well as certain flat blanks used to form them, originating in or exported from China. The official definition includes exclusions, notably upgraded clay-coated paperboard and cups and containers packaged in party sets with other tableware. The precise scope must therefore be checked for each product.

Does this decision already set duty rates?

No. The CITT decision of October 16 does not set any anti-dumping or countervailing duty rate. The Tribunal examines injury to Canadian industry, while the CBSA investigates dumping and subsidizing and determines any applicable duties.

According to the schedule announced by the CBSA, preliminary determinations are expected by November 16, 2026. Any provisional duties will depend on those determinations. It would therefore be premature to announce a rate or describe duties as already established by the October 16 decision.

What can distributors and buyers do?

For cafés, restaurants, hotels and distributors, this milestone is an opportunity to review cup requirements and supply sources. Comparing sizes, lid compatibility, quantities, lead times and customization options can help businesses plan their orders with greater clarity.
